In the predawn hours of Saturday morning, Senate Majority Leader John Thune initiated cloture on the Digital Asset Market Clarity Act, establishing a procedural vote for September 15. The motion was submitted at 4:52 a.m. ET, concluding an extended overnight legislative session that continued well beyond the Senate’s planned Friday adjournment.

The CLARITY Act aims to create a comprehensive federal framework for digital asset markets. The legislation would determine whether cryptocurrency assets are classified as securities or commodities while assigning regulatory authority between the Securities and Exchange Commission and the Commodity Futures Trading Commission.

Filing for cloture doesn’t guarantee the bill’s passage. Rather, it restricts debate time regarding whether the legislation should proceed to full floor consideration.

With Republicans controlling 53 Senate seats, they require a minimum of seven votes from Democrats or independents to achieve the 60-vote supermajority needed for advancement.

Speaking with The Block last week, Thune indicated that Democratic lawmakers had demanded no vote occur before the August break. “We’re getting that queued up first thing when we come back,” he stated.

Outstanding Issues Remain on the Table

The cloture motion doesn’t address the contentious issues that halted progress on the bill prior to the August recess. According to a Democratic Senate aide, three primary obstacles persist: ethics standards, illicit finance safeguards, and incorporation of Senate Agriculture Committee language.

Regarding ethics, Senators Ruben Gallego and Thom Tillis forwarded a bipartisan compromise to the White House last month. The proposal would prohibit government officials and their spouses from launching or endorsing digital assets, while mandating President Trump sell his cryptocurrency business interests. The President has yet to approve the terms.

Republican unity also appears fragile. Senator Josh Hawley announced he won’t support the legislation until it properly addresses concerns about deposit flight from traditional banking.

The Crypto Council for Innovation described the cloture filing as “a critical step forward” while expressing disappointment that a complete Senate vote wasn’t scheduled before the recess. The organization announced plans to engage both parties throughout August to secure sufficient votes for September approval.

Galaxy Research revised downward its probability assessment for the CLARITY Act passing in 2026 from 50% to 30% last month. The research firm pointed to an increasingly compressed Senate schedule as the primary factor.

Senators reconvene in Washington on September 14. This creates a narrow timeframe for deliberation and voting before focus inevitably turns toward the November midterm elections.
