The prediction market operator Novig has initiated federal legal proceedings against Wisconsin state authorities, attempting to prevent the state from enforcing its gambling regulations on sports-related contracts available through its platform.
On August 14, the company submitted its 45-page legal complaint to the U.S. District Court for the Western District of Wisconsin. The filing requests both preliminary and permanent injunctive relief, alongside a declaratory judgment establishing federal law supremacy over state regulations.
The Commodity Futures Trading Commission granted Novig’s operational arm, Ludlow Exchange LLC, contract market designation on June 16. Approximately one week prior to filing litigation, the platform commenced offering event contracts to Wisconsin residents.
The Company’s Legal Strategy
The platform maintains that its sports-related contracts constitute federally supervised derivatives falling under the Commodity Exchange Act. According to Novig, this classification subjects them to CFTC’s sole regulatory authority, thereby superseding state-level gambling statutes.
This represents Novig’s stated legal theory and awaits judicial review by the Wisconsin court. The company has requested expedited proceedings, asserting that potential state enforcement actions present what it characterizes as “imminent and existential” threats to its operations.

Challenging Legal Environment
Novig confronts a challenging legal landscape in Wisconsin. In April, the state filed lawsuits against Kalshi, Polymarket, Crypto.com, Robinhood, and Coinbase, claiming their sports event contract offerings breached the state’s prohibition on commercial gambling and constituted a public nuisance.
Subsequently, the CFTC filed suit against Wisconsin and sought judicial intervention to prevent state enforcement measures. On July 28, Judge William Griesbach rejected this petition. Meanwhile, Novig has pursued commercial growth initiatives. On July 30, the company revealed a multiyear partnership agreement with the New York Mets, designating it as the team’s exclusive official prediction market collaborator. The arrangement encompasses advertising opportunities at Citi Field and during broadcasts, plus access to official MLB data feeds.
According to the latest available court records, Wisconsin authorities have not yet submitted a comprehensive response, and the court has not issued a determination regarding the injunction petition.
