The lawsuit was filed last year by Alabama Attorney General Steve Marshall. It claims TikTok made its platform addictive to young users and misled the public about its safety measures.

The trial is expected to last two to three weeks. It could offer a rare look into how TikTok operates, since the company has settled other cases before they reached court.

What Alabama Is Claiming

Alabama argues that TikTok’s endless video feed makes it the most addictive social media platform available. The state says the app’s algorithm steers young users toward increasingly intense content, including material about violence and self-harm.

According to the lawsuit, this pattern has contributed to a teen mental health crisis in the state. Alabama says emergency room visits linked to self-harm have risen sharply as a result.

The lawsuit also claims TikTok misrepresented how it limits young users’ exposure to sexual and violent content. Alabama says this was done so the app could receive safe ratings for teens in app stores run by Google, Apple, and Microsoft.

Separately, the state accuses TikTok of misleading users about the Chinese government’s potential access to US user data. Alabama is seeking financial penalties and other legal remedies through the case.

TikTok’s Defense and Age Verification Issues

TikTok has said it designed the platform with teen safety as a top priority. The company points to Section 230 of the Communications Decency Act, which it argues shields online platforms from liability over content posted by users.

The lawsuit claims TikTok relies on users to self-report their age. But it also alleges the app lets people view videos without creating an account, allowing TikTok to collect viewing data even from unverified users.

Alabama argues this loophole makes features like Kids Mode largely ineffective, since there is no reliable way to confirm a user’s real age. The state also claims young users get trapped in filter bubbles that feed them increasingly extreme content.

This is not the first legal fight TikTok has faced over these issues. The company previously settled every case that had been selected for trial, including claims from five young plaintiffs and a Kentucky school district.

TikTok also faces thousands of additional lawsuits from individuals, school districts, and municipalities. Meta Platforms, Snap, and Alphabet’s YouTube are named as defendants in many of these same cases.

Last month, Meta agreed to a $17.1 billion settlement covering 47 states, Washington, D.C., and US territories. Meta did not admit wrongdoing but agreed to change how teens access Instagram and Facebook.

Part of that settlement, $5 billion, is conditioned on TikTok, Snap, and YouTube adopting similar safety terms. TikTok has not commented publicly on the Meta settlement.

Representatives for TikTok and the Alabama attorney general’s office did not respond to requests for comment ahead of the trial. The case begins Monday in Montgomery state court.
