On Thursday, October 8, 2026, Evanston Insurance Company filed an amended complaint in the US District Court for the Western District of Texas against Dory Creek, LLC, doing business as Bitdeer Inc.; St. Anthony’s Brokerage Company, doing business as Kodis Transportation; and LAF Logistics Inc. The suit concerns the disappearance of cryptocurrency mining computers belonging to Crusoe Energy Systems, LLC.
Evanston, an Illinois corporation, brought the case as subrogee of Crusoe, its insured, after paying Crusoe’s insurance claim. The filing says the insurer’s damages currently exceed $1.2 million. The case, numbered 6:26-cv-00543, is in the Waco Division. It was first filed in Texas state court. Bitdeer removed it to federal court on or about August 20, and Kodis joined the removal on September 18.
According to the complaint, Crusoe signed a hosting agreement with Bitdeer around December 23, 2022, to house its miners at a data center in Rockdale, Texas. In 2024, Crusoe decided to move some of the machines to a colocation site near Hobbs, New Mexico, and paid Bitdeer to power them down, pack them, and stage them for pickup.
Crusoe hired Kodis as freight broker. Kodis issued a quote dated July 15, 2024, for a July 17 pickup of 1,120 miners packed in 20 Gaylords, at a price of $2,242. Kodis named Skyline Logistics, LLC, as the carrier. The complaint alleges the broker-carrier agreement with Skyline was dated just two days before pickup and that Kodis has been unable to confirm Skyline signed it or knew of the shipment.
The filing says a truck marked LAF Logistics, not Skyline, arrived at Rockdale on July 17. The driver displayed a bill of lading number on a phone rather than presenting paper documents or identification, the complaint states. It alleges Bitdeer personnel matched that number to the Crusoe shipment, loaded the miners, and let the truck leave without comparing its USDOT and motor-carrier numbers to those of the authorized carrier.
The complaint says the shipment never reached Hobbs. It alleges Kodis tracked a cellphone associated with the purported driver rather than the truck or cargo, and that by July 18 Kodis could not obtain the truck’s location. Kodis flagged the load as missing at about 10:12 p.m. on July 19 and notified Bitdeer on July 20, the filing alleges.
Evanston alleges the phone number Kodis recorded for the Skyline driver was also used to direct LAF to Rockdale and to coordinate later transfers of the miners. The complaint says they may have passed to another carrier in Phoenix and then to an unidentified carrier in California. The miners have not been found.
The complaint lists nine counts. Against Bitdeer, it alleges breach of contract, breach of bailment, conversion, and negligence. Against Kodis, it alleges breach of contract; negligence, negligent undertaking, negligent performance of a contract and negligent selection; and gross negligence. Against LAF, it alleges liability under the Carmack Amendment, 49 U.S.C. § 14706. A ninth count asserts vicarious liability against all defendants.
Evanston seeks damages, attorneys’ fees on its contract claims under Chapter 38 of the Texas Civil Practice and Remedies Code, court costs and interest. It has demanded a jury trial.
