The statutory deadline for federal regulators to issue final payment stablecoin implementing rules passed on July 18, 2026, one year after the GENIUS Act’s enactment, with no primary regulator having finalized them.
The Federal Reserve did not publish its core issuer proposal until September 29, leaving the least runway before the Act’s January 18, 2027 outer date.
By waiting until late September to issue its Notices of Proposed Rulemaking, the Fed compressed the remaining timeline for final rule implementation. With no final rules issued in time, the January 18, 2027 date now governs by default.
Under Section 108 of the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act, the law takes effect on the earlier of January 18, 2027, or 120 days after final regulations are published by primary federal payment stablecoin regulators. With public comment windows for late-filing agencies remaining open well into the fourth quarter of 2026, regulators face a tight timeframe to review public feedback, coordinate interagency harmonization, and publish final rules before the statutory outer boundary arrives in 91 days.
Direct Primary-Source Audit of Federal Agency Rulemaking Dockets
As of publication, no primary regulator has issued a final rule across the execution timeline:
- Department of the Treasury (State Similarities): Published its initial Notice of Proposed Rulemaking (NPRM) under Docket ID TREAS-DO-2026-0232 (FR Doc. 2026-06489, 91 FR 14210) on April 3, 2026, establishing principles for evaluating state stablecoin regimes. The comment window closed on June 2, 2026.
- Department of the Treasury (Issuance Standards): Published an NPRM for payment stablecoin issuance under Docket ID TREAS-DO-2026-0496 (FR Doc. 2026-17842, 91 FR 35112) on August 18, 2026. The public comment window closes today, October 19, 2026.
- Department of the Treasury (SCRC Forms & Procedures): Issued an Interim Final Rule under Docket ID TREAS-DO-2026-0562 (FR Doc. 2026-19966, 91 FR 61688) on September 30, 2026. This rule establishes immediate administrative procedures for the Stablecoin Certification Review Committee, with post-promulgation comments open through November 30, 2026.
- Office of the Comptroller of the Currency (OCC): Issued its proposed capital and reserve requirements for national bank issuers under Docket ID OCC-2025-0372 (FR Doc. 2026-04812, 91 FR 10892) on March 12, 2026. Following the close of comments in May, the OCC announced that its final rule will arrive before the end of October 2026.
- Federal Deposit Insurance Corporation (FDIC): Published tailored standards for insured depository institutions under FDIC RIN 3064-AG88 (FR Doc. 2026-07921, 91 FR 16402) on April 18, 2026, closing comments on June 17, 2026.
- Board of Governors of the Federal Reserve System: Published its core payment stablecoin issuer framework under Docket No. R-1854 and RIN 7100-AG92 (FR Doc. 2026-21104, 91 FR 60812) on September 29, 2026—issued after the July 18 final-rule deadline had already passed. Public comments remain open through November 30, 2026.
- National Credit Union Administration (NCUA): Published joint credit union activity guidance under NCUA Docket NCUA-2026-0041 (FR Doc. 2026-09874, 91 FR 20114) on May 11, 2026, closing its docket on July 10, 2026.
November Comment Windows Force Compressed Implementation Phase
Because the Federal Reserve’s public comment window under FR Doc. 2026-21104 remains open through November 30, 2026, the central bank cannot legally publish a finalized rule until December 2026 at the earliest.
Under the statutory 120-day transition clause in Section 108, any final rule published after September 20, 2026, fails to trigger an accelerated effective date ahead of January 18, 2027. Consequently, the default January 18 outer limit now serves as the primary target.
However, if the Fed and FDIC require additional weeks in December and January to reconcile public comments against OCC and Treasury frameworks, market participants will face a narrow window between final rule publication and mandatory compliance.
What Market Participants Must Monitor Before Year-End
With the Treasury’s main issuance comment period closing today, October 19, attention shifts to the OCC’s imminent final rule release.
If the OCC publishes its final standards this month while the Fed continues accepting comments through late November, national banks and non-bank stablecoin issuers will navigate a staggered compliance environment. Issuers must monitor official Federal Register notices over the next 60 days to determine whether regulators achieve interagency alignment before the statutory deadline arrives.
