Los Angeles Complaint Alleges Man Misused Seed Phrases to Empty Crypto Wallets

On Tuesday, October 6, 2026, Agnes Krok filed a complaint in the California Superior Court, Los Angeles County, against Mark Nechi, accusing him of taking cryptocurrency from her digital wallets without her knowledge or consent in late 2023. The case, filed at the Santa Monica Courthouse, names 60 unidentified “Doe” defendants alongside Nechi.

According to the complaint, Krok, a Los Angeles County resident who is representing herself, entrusted Nechi with the seed phrases for her Trust Wallet and MetaMask Wallet in the fall of 2022 and fall of 2021, respectively. She alleges he promised to use them only to help recover her assets if something happened to her.

The filing states that Nechi used the credentials between November 21 and December 1, 2023, to move all of the bitcoin from her Trust Wallet in 13 transfers. It alleges he then emptied her MetaMask Wallet between December 13 and December 27, 2023, removing 5.08 Ether, 20.36 Chainlink, and 794.9 Polygon. The complaint lists the date, time, and amount of each transfer in two tables. It says the bitcoin totaled 0.3845, though some paragraphs cite 0.3841.

Krok says she discovered the assets were missing on or around April 14, 2024. The complaint alleges Nechi admitted taking the bitcoin when she asked him about it, saying he had staked it, meaning it was locked for a fixed term in exchange for interest.

On April 25, 2024, the two signed a “Bitcoin Custody Acknowledgement and Return Agreement,” according to the complaint. In it, Nechi allegedly acknowledged holding Krok’s 0.3845 bitcoin without her consent and agreed to return it, plus 7.4 percent annual interest, by the end of June 18, 2024. The agreement allegedly protected Krok against price swings, using a benchmark of $66,340 per bitcoin, or $25,482 in total value. It also included a screenshot showing Nechi’s wallet held 4.301 bitcoin.

The complaint says Nechi did not return the bitcoin by the deadline. It states he sent 0.038005 bitcoin on June 20 and 21, 2024, covering only interest.

Krok alleges Nechi initially denied taking the assets from the MetaMask wallet. She says public blockchain records link him to the transfers. According to the complaint, all 30 Ether transfers went to a single Ethereum address, which received more than 55 percent of its incoming transactions from a second address. That second address registered the domain names “nechi.eth,” “redbullairforce.eth” and “redbullstratos.eth” in 2024, the filing says. It states Nechi worked at Red Bull from 2015 to October 2023, managing the Airforce and Stratos projects. Krok says she sent Nechi the findings on August 5, 2024, and that he confirmed receipt by August 8, 2024, without responding to them.

In June 2025, the complaint says the two verbally agreed to a new repayment plan totaling $75,261 for all assets, to be paid in U.S. dollars through Venmo and tracked on a shared Google Sheet. Nechi allegedly paid $6,937 between June and November 2025 and then stopped, missing more than 40 weekly payments. The complaint lists the remaining balance as $68,324.

It alleges that Nechi lived in Los Angeles County until about October 2024 and now lives in Naperville, Illinois.

The complaint brings five causes of action: conversion, fraud under California Civil Code sections 1709 and 1710, violation of Penal Code section 496, breach of contract, and fraud under Civil Code section 1572.

Krok seeks compensatory damages, treble damages on the Penal Code claim, punitive damages, prejudgment interest, attorney’s fees, and costs. She has also demanded a jury trial.
