Bitcoin dropped sharply on Tuesday after a key crypto regulation bill failed to pass the U.S. Senate, adding to pressure from rising Treasury yields and oil prices.

The Clarity Act, which aimed to create a regulatory framework for digital assets, was rejected in a 49-50 vote. The bill had already cleared the Senate Banking Committee in May but could not reach the 60 votes needed to advance.

Every Republican voted in favor except Senators Susan Collins, Josh Hawley, Jerry Moran, and Thom Tillis. One senator did not vote.

Senator Cynthia Lummis (R-Wyo.), who led efforts to build Democratic support, said the bill’s final version included ethics provisions that met Democratic demands. After the vote, she posted on social media: “Senate Democrats proved they were never truly serious about protecting consumers and preserving American leadership.”

Crypto trader Daan Crypto Trades noted on X that the Clarity Act failure confirmed August lows had been broken. He wrote that an algo sell-off was to be expected and pointed to the upcoming FOMC meeting as a reason for further caution, adding that “market reaction is more telling than the actual news itself.”

Bitcoin ETFs Record Biggest Outflow Since June

Spot Bitcoin ETFs saw $450.4 million in net outflows on Tuesday, the largest single-day withdrawal since June 24, when funds shed $469 million during a tech sell-off.

Fidelity’s FBTC led the losses with $214.8 million in outflows. BlackRock’s iShares Bitcoin Trust followed with $161.7 million. Grayscale’s GBTC, ARK 21Shares, and Bitwise ETFs made up the remainder.

This followed $159.9 million in inflows just the day before.

Industry Response Stays Measured

Key disagreements over the Clarity Act involved how yield payments on stablecoins would be treated and how regulation would be split between the SEC and CFTC.

Strategy, the largest corporate Bitcoin holder, posted on social media that “Bitcoin has had legal and regulatory clarity in the U.S. for years,” pushing back against the idea that the bill’s failure was a setback for the asset.

Blockchain firm tZERO said the vote did not change the trajectory toward regulated digital asset markets, citing proposed rulemaking and growing SEC-CFTC coordination as alternative paths.

Bitcoin was trading at $75,700, down 2.5% over 24 hours at time of writing, according to CoinMarketCap.
