What to know:

  • Brazil crypto rules will delay transfers above $10,000 by up to 24 hours starting in 2027.
  • The measure targets transfers to foreign VASPs and self-custody wallets to curb fraud and illicit activity.
  • Brazil crypto exchanges must strengthen monitoring and track customers’ combined daily transfer amounts.

Brazil crypto regulations are going to get tougher as the country is about to introduce new restrictions on digital asset transfers over some limit. The Central Bank of Brazil said some cryptocurrency transfers over $10,000 will have a delay of up to 24 hours as part of new fraud prevention measures.

This regulation will come into force in 2027 and will apply to transfers to foreign virtual asset service providers and self-custody wallets. This $10,000 amount can be reached via a single transaction or through the sum of all customers’ cryptocurrency transfers performed in one day.

Brazil Crypto Rules Target Fraud Risks

According to the Central Bank, the new regulation was initiated in view of increased adoption of digital currencies and stablecoins by fraudsters. This is because digital currencies are easy to transfer from one country to another in a very short period of time, thus making it hard to detect any illegal transactions.

Concerning the new Brazilian cryptocurrency regulation, the temporary delay will give more time for the analysis of the transactions to check their legitimacy or fraud.

This delay could also be applied to those transactions that need further verification under the risk management policies of the financial institution.

Large Crypto Transfers Could Face Delays

It has been highlighted by the Central Bank that there would not be any permanent freezing of cryptocurrencies. The time gap would provide more time to the compliance department in order to thoroughly check the transaction.

Transfers which are below $10,000 would not come under the scope of this specific regulation.

For instance, a transfer of $15,000 in cryptocurrencies to an offshore virtual asset company or to a self-custody wallet would be delayed for a maximum of 24 hours.

Brazil Crypto Exchanges Must Upgrade Monitoring

Transaction monitoring mechanisms will need to be improved for Brazil crypto exchanges and VASPs prior to the introduction of new rules.

It will be necessary to detect transactions that exceed $10,000 and monitor the total transfer amount by a certain client daily. The change will require considering multiple transactions at once rather than each transfer separately.

This is anticipated to provide a better understanding of the behavior of clients making multiple large transactions at once.

Brazil Expands Digital Asset Oversight

The newest crypto regulation in Brazil is one of the steps that the country has taken to enhance supervision of the digital currency industry. Since 2023, Brazil has been working on the regulation of the cryptocurrency market, which includes the obligation of exchanges to be registered at the central bank.

The new guidelines impose stricter supervision over international crypto transactions, with regulatory bodies focusing on the rapidity of money transfer through crypto assets and stablecoins.

A 2027 deadline for the guidelines gives sufficient time to crypto organizations to align with the regulations. For customers, the transaction will be delayed in some larger transfers.
