The U.S. Senate’s crypto market structure bill is running out of time. Senate Majority Leader John Thune said Thursday that the Digital Asset Market Clarity Act will likely miss its August 7 target deadline — the window the industry had pinned its hopes on for a 2026 passage.

Thune did leave a small opening. He told reporters he would like to “at least get Clarity started” before the long summer recess begins. Getting the bill moving before senators leave could keep it alive for a narrow September window.

But that path is far from certain.

Ethics Provisions Are the Sticking Point

The biggest roadblock right now is a dispute over ethics language. The bill includes a provision that would bar all federal officials — including President Trump — from issuing or sponsoring digital assets.

Democrats say that language doesn’t go far enough. Senator Ruben Gallego of Arizona didn’t hold back. He called the GOP’s ethics draft a “piece of shit” in comments to Politico, saying it was “not a serious effort” after months of bipartisan work.

Republicans pushed back hard. Senator Bernie Moreno called the same language “the most powerful ethics language in US history.”

Gallego said he would work with Senator Thom Tillis on a counterproposal. “We are still in this fight,” he said.

What Happens If the Bill Misses August

The Senate returns for roughly three weeks in September. But midterm election campaigning will compete for lawmakers’ attention, and other bills are already lined up for floor time.

The next Senate priority is a bipartisan sanctions bill targeting Russian leadership — legislation championed by the late Senator Lindsey Graham. That bill is expected to reach the floor next week.

White House crypto adviser Patrick Witt said he was “perplexed” by Thune’s remarks and remains slightly more optimistic. He pointed to the first week of August, when the Senate is still in session, as a possible opportunity.

“I wouldn’t count it out,” Witt told CoinDesk TV.

Still, if the bill doesn’t pass the Senate in 2026, the House would also need to act — adding more uncertainty to an already complicated timeline.

The Clarity Act is considered the top priority for the crypto industry, designed to give digital assets a permanent legal foundation in the U.S. Even getting it to a Senate floor vote requires clearing a 60-vote threshold, and right now, support from enough senators is not guaranteed.

Senator Cynthia Lummis, a lead negotiator on the bill, said the most disputed sections are still open for changes that could bring Democrats on board. Whether those deals can be reached before recess remains to be seen.
