McDonald’s (MCD) stock dipped 0.25% Tuesday as the fast-food chain faced fresh scrutiny over a new lawsuit targeting its pricing practices. The case centers on an AI-enhanced tool the company gives to U.S. franchisees.

The lawsuit was filed Friday in federal court in Chicago. It proposes a nationwide class action against McDonald’s.

Plaintiffs claim the company’s pricing system illegally coordinates menu prices across franchises and company-owned restaurants. The suit alleges this violates U.S. antitrust law.

According to the complaint, the tool collects data that competing franchises wouldn’t normally share. That includes store-level sales figures.

“The result is algorithmic price-fixing aimed at customers who are already stretched thin,” the lawsuit states. It argues independent businesses are required to set prices on their own.

McDonald’s pushed back hard on the allegations. The company called the lawsuit “filled with inaccuracies” and said it would defend itself vigorously.

“AI does not set menu prices at McDonald’s restaurants – McDonald’s franchisees do,” the company said in a statement. It added that the tools are optional and don’t automate or fix pricing.

How the Pricing Tool Works

McDonald’s says it has used an AI-enhanced pricing tool for more than a decade. The system calculates suggested prices based on a store’s sales history, location and local competitor pricing.

Franchisees own and operate 95% of McDonald’s roughly 14,000 U.S. locations. The company says it only provides recommendations, not mandates.

“All we do is provide the context of what’s going on,” a McDonald’s spokesman told the Associated Press. “We don’t have any way to affect the menu pricing in a restaurant.”

The lawsuit disagrees, arguing McDonald’s holds leverage over franchisees that can pressure them into following its guidance.

Value Push and Franchisee Pushback

The dispute comes as McDonald’s tries to win back lower-income customers. The chain has pushed value deals across its U.S. menu for several years.

During an August investor call, CEO Chris Kempczinski said only 60% of U.S. restaurants were offering the company’s proposed $3 menu of 10 items. He noted that getting franchisees on board takes work.

“As you know, in our system, that’s not something that we just flip the switch on,” Kempczinski said. “It requires conversations with franchisees.”

Lark Turner, a lawyer for the plaintiff, said McDonald’s is “leveraging its troves of data and its franchised system to nickel-and-dime consumers down to the last French fry.”

The lawsuit is seeking to represent a class of potentially millions of McDonald’s customers. It asks the court to certify the case and order McDonald’s to pay damages.

It also seeks an order preventing McDonald’s from enforcing agreements that restrict competition among franchisees. The Associated Press left a message Tuesday with the National Owners Association, which represents McDonald’s franchisees, but had not received a response.
