Sam Bankman-Fried asked the U.S. Supreme Court on September 10, 2026, to review his fraud conviction, grant him a new trial and overturn an approximately $11 billion forfeiture order, according to reports citing his filed petition. Petition seeks new trial and forfeiture reversal

The Supreme Court filing is Bankman-Fried’s latest attempt to undo the outcome of the criminal case arising from the collapse of FTX. His petition seeks review of both the conviction and the approximately $11 billion forfeiture, The Block reported.

The immediate effect of the filing is to put the case before the Supreme Court for consideration. The petition itself does not reverse the judgment that is currently in force.

FTX asset evidence and excessive-fines challenge

The petition’s evidentiary argument concerns FTX and Alameda’s ability to repay customers: Bankman-Fried says the trial court improperly prevented him from presenting that evidence, according to FinanceFeeds.

Its second challenge is to the approximately $11 billion forfeiture, which the petition characterizes as an unconstitutional excessive fine. The requested relief is broader than that order alone: Bankman-Fried is asking the court to set it aside, overturn the conviction and grant a new trial.

Second Circuit rejected the same arguments in June

The U.S. Court of Appeals for the Second Circuit affirmed Bankman-Fried’s conviction, 25-year sentence and approximately $11 billion forfeiture on June 12, 2026. In its opinion, the court held that the government did not need to prove an intent to cause economic loss.

That holding is directly relevant to the new petition’s proposed evidence about assets available for customer repayment. The Second Circuit also rejected Bankman-Fried’s challenge to the forfeiture under the excessive-fines doctrine, leaving both the prison term and the financial order intact unless the Supreme Court intervenes.
